Report a Copyright Infringement

To submit a valid DMCA notice (17 U.S.C. § 512(c)(3)), email legal@peachesncream.app with the subject line “DMCA Takedown Notice” and include all of the following:

1. Your contact information — your full name, mailing address, phone number, and email address.
2. Identification of the copyrighted work — describe the work you own or represent (e.g., “my photograph titled X,” “my song Y released on Z”).
3. Location of the infringing material — provide the in-app URL, post link, or a description specific enough for us to locate the content.
4. Good-faith statement — “I have a good-faith belief that the use of the material described above is not authorized by the copyright owner, its agent, or the law.”
5. Accuracy statement — “I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or am authorized to act on the copyright owner’s behalf.”
6. Your signature — your physical or electronic signature.

Notices missing any of these elements may be rejected. Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing may result in liability for damages.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may send a counter-notification to our Designated Agent that includes (17 U.S.C. § 512(g)):

1. Your physical or electronic signature.
2. Identification of the removed material and where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, and phone number, a statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or any judicial district in which we may be found, if you are outside the United States), and that you will accept service of process from the party who filed the original notice.

Upon receipt of a valid counter-notification, we may restore the removed material within 10–14 business days unless the original complainant files a court action to restrain the activity.

Repeat Infringer Policy

Peaches’nCream has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. See our Terms of Service for full details.
